Like negligence, recklessness is a state of mind showing the level of intent to determine liability in civil cases. Reckless behavior is intentionally committing an unreasonable act with disregard for the level of risk despite the known or obvious likelihood that harm would follow. The Iowa courts explicitly define reckless behavior as willful disregard for the safety of people or property.

Reckless conduct goes beyond lacking reasonable care to prevent unintentional injury to another person. Recklessness is a conscious state of mind and a willful disregard for the consequences of one's actions.

The reckless act must also be highly dangerous, and the danger must be such that any reasonable person would foresee the potential harm being more likely than not to result from that act. However, even though the intent is to commit the act, and the disregard is for the consequences of the results of that act, the intent need never exist to cause harm.

For example, if a person drives his or her car in such a manner so as to indicate a willful or wanton disregard for the safety of people or property, then recklessness exist.

The Iowa Supreme Court has held that accidents caused by people driving while under the influence (commonly known as DUI, and legally referred to as OWI in Iowa) are reckless acts.
